Yes. The Federal Arbitration Act establishes standards of fairness for all pre-dispute arbitration agreements. Courts will rule an arbitration agreement “unconscionable” and release the parties from portions of the agreement (or all of the agreement) if the agreement contains unfair terms or is presented in an unfair manner. In this way, consumers are protected from biased or otherwise unlawful arbitration agreements.
